These terms and conditions apply to tourism consulting services (and any other services as outlined below) provided from the time when the travel agent confirms that he/she has received the payment/deposit for the tour to the end of the tour (in the event of a conflict or complaint, the contract will end when the agreed services have been fulfilled). The principle parties covered by these terms and conditions are The China Guide, the main point of contact for the tour, and all participants in the planned tour.
Prices and payment
The China Guide provides tour information and booking services in China. Our obligations, and those of our suppliers, are to take reasonable skill and care to provide the services or facilities that form part of your booking with us.
The China Guide will be liable if any important information regarding your tour is not provided. You are responsible for reading all the information provided to you. Any fees arising from your own negligence won’t be covered.
Local standards of China will be relevant regarding the contract and the quality of the services provided.
Carriage (by air land or sea) is subject to the terms and conditions of carriage of the actual carrier. This may limit or exclude The Chine Guide liability. Our liability will not exceed that of any carrier.
Compensation will not be payable in the event that an amendment, change or cancellation is due to an unusual or unforeseeable event or circumstance beyond our reasonable control including, but not limited to, war, threat of war, riot, civil disturbance or strike, terrorist activity (actual or threatened), industrial disputes, technical or maintenance problems with transport, machinery or equipment, power failure, natural or nuclear disaster, fire, flood, drought, adverse weather conditions, levels of water in rivers, acts of god, act of government, closure of airports, changes of schedule or operational decisions of transport providers, (each such event or circumstance being defined in these Booking Conditions as “force majeure”).
The China Guide reserves the right to substitute hotels, flights, trains, or cruises, to alter itineraries, or to cancel the tour prior to departure. If The China Guide has to cancel your tour before it starts, we will refund your money according to the cancellation policies defined in this page. The reimbursed amount shall be limited to a maximum of twice the price of your trip.
Whilst we will endeavor to comply with any special requests we receive (such as airline seating, dietary requirements or specific rooms) and will pass any special requests to the relevant supplier, however, we are unable to guarantee compliance with such requests and are not liable for any loss suffered in the event of such requests not being complied with.
Excursions and activities
The China Guide agrees to use reasonable skill and care in selecting suppliers to provide excursions and activities as part of your contract. Such activities include boat trips, mountain climbing, and entering and exiting tombs and caves etc. You will receive relevant advice from our representatives during the activities. The China Guide is not responsible for any action or event that occurs after our agents have exercised their duty and taken the necessary care.
Any excursions and/or activities that you purchase separately from a local or third party once your trip has started will not form part of your contract with us.
Cancellation and amendments by you
If you wish to change your travel arrangements in any way after we have issued the booking confirmation, we will do our best to assist you in amending your arrangements after booking, but cannot guarantee that this will be possible.
If you or any member of your party is prevented from going on your confirmed trip for reasons beyond your control, for example, death of a close relative or jury service, you/they have the right to request the transfer of your/their booking to another person, subject to our prior approval.
Please note that in many cases, scheduled airlines apply 100% cancellation charges and will not permit name changes or other booking alterations.
Cancellation charges reflect the many expenses The China Guide cannot recover if you cancel, even if you must do so due to illness, injury, or personal emergencies. These fees are not meant to be punitive. The charges made reflect the expenses The China Guide has incurred in administering your reservation and planning for your tour. We recognize that the majority of those who cancel their reservations do so out of necessity. Please note that we do not make any refunds for any unused portion of your trip, including failure to arrive, arriving late or leaving the trip early.
The cancellation date is the date The China Guide receives notice by email or phone call.
Refunds for single city tours
Refunds for multi-city tours or tours including flights, trains or hotel bookings
For camping and sleeping on the Great Wall
The tour may be rescheduled more than 24 hours in advance without penalty. This allows for change of plans, illness or bad weather.
For tours that include a Yangtze River cruise
The deposit is non-refundable if the tour is canceled less than 20 days in advance.

Cancellation and amendments by us
Amendments before departure
Occasionally, it is necessary for us to make changes after your booking has been confirmed.
If the change is material (for example, a change of flight time by more than 12 hours, change of carrier, change of destination or change of accommodation to one with a lower official rating), we will notify you as soon as practically possible and offer you the choice of:
If the change is minor, we will do our best to notify you in advance of departure.
Amendments during the trip
If we are unable to provide a significant proportion of your trip whilst you are away, suitable alternative arrangements will be made for you at no extra cost for the continuation of your trip and we will, where appropriate, compensate you for the difference between the services contracted for and those supplied.
If it is impossible to make such alternative arrangements or these are not accepted by you for good reasons, we will give you the option to return to your point of departure or to another place which you have agreed (subject to flight/transport availability) and will, where appropriate, compensate you. This does not apply to minor changes in your accommodation, itinerary or transportation arrangements.
Whilst we hope that we will never have to cancel your trip, this is very occasionally necessary and we reserve the right to do so. We will do our best to offer alternative arrangements of a comparable or better standard with any appropriate refund, or will give you a full and prompt refund of the price of the trip. We will also be liable to pay appropriate compensation to you unless the reason for cancellation is force majeure.
Complaints and claims
If the service we offer is significantly different from the one we agreed when you booked, please inform your travel agent as soon as practically possible.
If you have any issues during your tour (for example, you can’t find your driver or your guide, you have an issue with the hotel we booked for you, etc.) please call your travel agent as soon as practically possible. If you fail to contact your travel agent, we are not liable to any fees you may incur.
In case of a complaint or claim for compensation, you must inform us by email, regular mail, or fax in writing within 15 days from the end of your tour. Relevant receipts and substantiating evidence must be attached to the letter of claim. The China Guide will not be liable for any claims made later than 15 days after the exact end of your tour. ■
